Terms of Service
Welcome to NoteSurfing. By downloading, installing, or using the NoteSurfing mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the App.
1. Who We Are
NoteSurfing is developed and operated by Alejandro Rivera, an independent developer based in Mexico City, Mexico. References to "we", "us", or "our" refer to Alejandro Rivera operating as NoteSurfing.
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you confirm that you have your parent or guardian's permission to use the App and agree to these Terms.
3. Account
You may register using Google or Apple Sign-In. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us immediately at support@notesurfing.com if you suspect unauthorized use of your account.
4. Free and PRO Tiers
NoteSurfing offers a freemium model. Level 1 (Fundamentos I) is available at no cost. Access to Level 2 and above requires a NoteSurfing PRO subscription, available in monthly and annual plans.
Subscription pricing varies by region. The current price for your country is displayed inside the app at checkout and in your App Store or Google Play subscription settings.
Subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective terms. Payment is charged to your store account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
5. Cancellations and Refunds
You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not process refunds directly — refund requests must be submitted through Apple or Google according to their respective policies.
6. User Content and Audio Data
Both the reading and intonation modules may record audio from your microphone to analyze your performance:
- Reading module: audio is transmitted to OpenAI's speech recognition service for transcription. We do not retain the original audio on our servers; OpenAI may retain it for up to 30 days under its API data usage policy, after which it is deleted automatically.
- Intonation module: audio is processed locally on your device and does not leave your device.
By using these features, you grant us a non-exclusive, worldwide license to use aggregated transcription results and derived analytics for the purpose of operating the App and training our own on-device recognition models, with the goal of providing real-time feedback without relying on external services. Original audio recordings are not retained on our servers. You may request deletion of your derived data at any time by contacting privacy@notesurfing.com.
7. Intellectual Property
All content in the App — including curriculum, design, graphics, audio, and software — is owned by or licensed to NoteSurfing. Musical compositions used in the App are in the public domain. You may not copy, reproduce, distribute, or create derivative works from any App content without our express written permission.
8. Prohibited Conduct
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App to transmit harmful, offensive, or illegal content
- Attempt to gain unauthorized access to any part of the App or its infrastructure
- Use automated tools, bots, or scripts to interact with the App
- Resell, sublicense, or commercially exploit the App or its content
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components. Your use of the App is at your own risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law, NoteSurfing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if we have been advised of the possibility of such damages.
11. Governing Law
These Terms are governed by the laws of Mexico. Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the courts of Mexico City, Mexico.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by updating the date at the top of this page and, where appropriate, through in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms.
