Welcome to NoteSurfing. By downloading or using the NoteSurfing app (the "App") you agree to these Terms. Please read them carefully; if you do not agree, do not use the App.

1. Who we are

NoteSurfing is developed and operated by Alejandro Rivera, an independent developer based in Mexico City, Mexico. "We" and "us" refer to him, operating as NoteSurfing.

2. Who can use the App

You must be at least 13 years old. If you are under 18, you confirm that your parent or guardian has allowed you to use the App and agrees to these Terms.

3. Your account

You can sign up with Google, with Apple, or with your email and a password. You are responsible for keeping access to your account safe and for any activity under it. If you think someone else is using it, email support@notesurfing.com.

4. Free plan and NoteSurfing PRO

Level 1 is free. Access to Level 2 and above requires a NoteSurfing PRO subscription, monthly or annual. Some features have daily usage limits depending on your plan, which are shown in the App.

Pricing depends on your country and is shown in the App before you pay, as well as in your App Store or Google Play subscription settings.

Payment is charged to your store account by Apple or Google when you confirm the purchase, and is also subject to their terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.

5. Cancellations and refunds

You can cancel at any time in your App Store or Google Play account settings. Cancellation takes effect at the end of the period you already paid for. We do not process refunds directly: they are requested from Apple or Google under their policies.

6. Your recordings

Some exercises record your voice in order to grade you. How these recordings are processed, stored and used is explained in our Privacy Policy. By using those exercises you authorize us to process your recordings to grade you and to use them, together with their analysis, to improve NoteSurfing and train our own evaluation models.

7. Intellectual property

All content in the App, including the curriculum, exercises, design, graphics, audio and software, is owned by us or used under license. The musical works included are in the public domain or used with permission. You may not copy, distribute or create derivative works from App content without our written permission.

8. Prohibited use

You agree not to:

• Reverse engineer the App or attempt to extract its source code.
• Attempt unauthorized access to the App or its infrastructure.
• Use bots, scripts or other automated tools to interact with the App.
• Resell the App or its content, or exploit them commercially.
• Use the App to send harmful, offensive or illegal content.

9. No warranties

The App is provided "as is". We work to make grading accurate and the App reliable, but we do not guarantee it will be free of errors or interruptions. The App's grading is a practice tool and does not replace a teacher's assessment.

10. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of the App.

11. Governing law

These Terms are governed by the laws of Mexico. Any dispute will be resolved before the courts of Mexico City.

12. Changes to these Terms

If we change these Terms, we will update the date above and, for significant changes, let you know inside the App. If you keep using the App after a change, you accept the updated Terms.
